THE CONSTRUCTION OF MEDIA NARRATIVES AND THEIR EFFECTS ON THE CRIMINAL PROCESS: A Study on the Elize Matsunaga Case

The purpose of this scientific article is to demonstrate the influence of media on the Criminal Process through a case study. Therefore, there is a need to explain the current media in Brazil and how it influences the criminal process. Pointing out that the media presents criminal events in a sensationalist way, in order to create greater public interest and is not always impartial, violating guarantees, invading privacy and assuming guilt. There is a need to analyze society's perspective in relation to female criminals. The practical example that will be examined is the “Yoki” Case, to understand how the media influenced it, due to its wide repercussion in Brazil. The method used was deductive, with bibliographical, legislative, and judicial decision research techniques, as well as the analysis of the Yoki case, to better understand the topic. Furthermore, in terms of Law, the demonstration and clarification of the Law and the Constitution in relation to the Criminal Procedure and the Media were essential.
