A IMPORTÂNCIA DO ATRIBUTO DA LINGUAGEM “CLAREZA” NA PETIÇÃO INICIAL PARA A EFETIVIDADE DO DIREITO PLEITEADO

RESUMO

O presente artigo científico tem por temática a relação intrínseca existente entre o Direito e a linguagem e, mais especificamente, o quão importante é a clareza  na Petição Inicial para que um direito possa ser efetivado. Objetiva-se demonstrar que a má escrita na peça inaugural do processo pode impedir ou retardar a aquisição do direito buscado. Para tanto, valeu-se do método dedutivo, utilizando-se de revisão bibliográfica e da análise qualitativa de peças processuais. Ademais, como técnica de pesquisa, vale-se, principalmente, da bibliográfica e documental. Observa-se, ainda, que a pesquisa se enquadra na vertente jurídico-sociológica.

ABSTRACT

This scientific article addresses the intrinsic relationship between law and language, with a particular focus on the importance of clarity in the Initial Petition for the effective enforcement of a right. It aims to demonstrate that poor writing in the opening document of a legal process can hinder or delay the attainment of the sought-after right. To achieve this, the deductive method was employed, using bibliographic review and qualitative analysis of procedural documents. Additionally, the research primarily relied on bibliographic and documentary techniques. It is also noted that the study falls within the socio-legal framework.
