APLICAÇÃO DA TECNOLOGIA BLOCKCHAIN NA CADEIA DE CUSTÓDIA: valoração das provas digitais

Abstract

This article aims to examine how digital criminal evidence is evaluated within the current chain of custody in Brazil. The ease and unrestricted access to evidence lack effective security against manipulation, facilitating data breaches and consequently violating fundamental rights. The analysis will explore to what extent Blockchain technology can ensure the probative value of evidence, whether it alone can maintain the immutability of digital evidence, and its implications. In other words, the research will help to understand these issues and potentially contribute pragmatically to the use of Blockchain technology for the secure storage and valuation of digital evidence. Finally, this research will employ a bibliographic method for its development and a hypothetical-deductive method for its conclusion, which involves formulating hypotheses followed by refuting falsifications of alternative technologies for simultaneous use with Blockchain technology.
