Abstract

Objectives of this study include presenting how the relationship between the occupations carried out by the Landless Workers' Movement (MST) and the process of land democratization in Brazil is established, as well as analyzing the legality and legitimacy of these occupations and their impacts within the Brazilian legal and social context. In this scenario, the aim is to investigate the legal foundations that support the actions of the MST, in accordance with Brazilian legislation, and to understand how these occupations are perceived within the legal community. Furthermore, the methodology is based on bibliographic research and the analysis of relevant laws and jurisprudence, with the intention of contributing to the public debate on agrarian reform and social justice in the country, providing a critical analysis of the legal, ethical, and political issues involved.

    Professor Doutor em Ciências Jurídico-Políticas pela Universidade de Lisboa, com reconhecimento pela UFF; Mestre em Direito pela Universidade Estadual Paulista - UNESP; Graduado em Direito pela UNESP. Licenciado em Filosofia pela Universidade Federal de São João del-Rei - UFSJ. Atualmente, realiza pesquisa de pós-doutorado em Administração Pública pela Fundação Getúlio Vargas - FGV. Professor de Direito na Faculdade de Direito de Franca, Universidade de Araraquara, e Fundação Educacional de Ituverava. Professor do programa de Mestrado em Direito da Faculdade de Direito de Franca. Tem experiência em Direito, com ênfase em Direito Administrativo, Direito Internacional Público e Privado, e Teoria do Estado, atuando principalmente como professor. Publicou diversas obras, incluindo "Curso de Ciência Política e Teoria Geral do Estado" e "Direito Internacional Público Resumido".
