The objective of this work is to study cases of obstetric violence in São Paulo during the pandemic and its reasons. In addition to analyzing Federal Law No. 11,108, which allows regulating women's right to have a companion during the birth process. However, during the pandemic, many hospitals began to disregard this law, increasing cases of obstetric violence. Even so, childbirth care in Brazil, especially in the State of São Paulo, is precarious and lacks effective and dignified care. Therefore, the research has legal-social relevance, analyzing constitutional principles such as equality and human dignity.
